- Contact with an uncontrolled hazard causes injuries.
- Safety is not just the responsibility of the worker.
- You must look beyond what the injured worker did.
- Analyze the design of the machinery, equipment or facility.
- The design is defective if a hazard that caused the injury could have been eliminated or safeguarded economically.
- You have a products liability case against the machine manufacturer if you can prove:
- The product was defective when used.
- The defect existed when the product was manufactured.
- The defect was the proximate cause of the injury.
- The specific use of the product that caused the injury was reasonably foreseeable.
